Правила проведения акции «Попробуй подписку «Кино и ТВ» за 0,05»

1. Используемые термины:

1.1. Рекламная акция «Попробуй Подписку «Кино и ТВ» за 0,05» (далее — «Акция») — акция, организатором которой является VASKIANI VENTURES LIMITED (далее — Компания), в рамках которой пользователь имеет возможность приобрести Подписку «Кино и ТВ» на 30 календарных дней по акционной цене в соответствии с табл. № 1 в период Акции. По окончании периода Акции, Участники Акции могут продолжить смотреть фильмы и каналы, доступные по Подписке «Кино и ТВ», по регулярной цене в соответствии с табл. № 1. Фактом оплаты Подписки «Кино и ТВ» по акционной цене, при помощи банковской карты, Участник Акции соглашается на автоматическое продление подписки и списание средств по регулярной цене на следующий период. После покупки Подписки «Кино и ТВ» по акционной цене, пользователь, в соответствии с законодательством, имеет право отказаться в любой момент в своем профиле от автоматического продления Подписки.

2. Подписка — в понимании настоящих Правил — Подписка «Кино и ТВ».

3. Организатор Акции: VASKIANI VENTURES LIMITED.

4. Период Акции: с 01.06.2016 г. по 31.12.19 г. включительно.

5. Срок действия акционной Подписки — 30 календарных дней со дня оплаты включительно.

6. Территория проведения Акции: страны, перечисленные в табл. №1.

7. Акция проводится на сайте megogo.net.

8. Акция не является конкурсом, лотереей либо иной основанной на риске азартной игрой, розыгрышем и т.п..

9. Участником Акции может стать зарегистрированный пользователь сайта megogo.net или приложения для SmartTV, который впервые приобретает Подписку. Повторная активация или продление Подписки осуществляется по ее регулярной стоимости на день оплаты.

10. Участником Акции может быть физическое лицо с необходимым объемом дееспособности согласно законодательству страны участника Акции. Исключением являются сотрудники, представители, члены семей работников Организатора Акции.

11. Права Участника Акции:

11.1. В случае изменений условий Акции, ознакомиться с информацией о таких изменениях.

11.2.  Принимать участие в Акции на условиях этих Правил.

12. Обязанности Участника Акции:

12.1. Ознакомиться с Правилами Акции.

12.2. Не нарушать условия этих Правил.

13. Права Организатора Акции:

13.1. Организатор Акции вправе изменить Правила Акции без предварительного уведомления Участников Акции.

13.2. В случае противоправных действий со стороны Участника, отстранить нарушителей от участия в Акции.

13.3. Запрашивать у Участника Акции необходимую информацию и документы в случаях, предусмотренных настоящими Правилами, а также иные документы, с целью их  предоставления в государственные органы, в случаях, предусмотренных законодательством страны участника Акции.

13.4. Отказать Участнику Акции в предоставлении доступа к Подписке в случае установления факта несоблюдения Участником настоящих Правил.

13.5. В случае возникновения каких-либо обстоятельств, препятствующих проведению Акции (например, неполадки либо сбои в сети Интернет, результатом которых стала невозможность дальнейшего проведения Акции), Организатор вправе временно приостановить или досрочно прекратить проведение Акции, без применения к нему каких-либо штрафных санкций.

14. Обязанности Организатора Акции:

14.1. Провести Акцию в соответствии с настоящими Правилами.

15. Для того, чтобы стать Участником Акции, необходимо осуществить покупку Подписки.

16. Организатор не несет ответственности за:

16.1. Неисполнение (несвоевременное исполнение) Участником Акции обязанностей и соблюдения условий, предусмотренных настоящими Правилами;

16.2. Правильность, точность и достоверность данных, контактной и иной информации, которую Участник Акции указал при получении доступа к Подписке на сайте megogo.net.

16.3. Неполучение Участником Акции доступа к Подписке в случае ее невостребования или отказа от нее Участником Акции, а также по иным причинам, не зависящим от Организатора Акции.

17. Факт участия в Акции является добровольным. Принимая участие в Акции, Участник Акции подтверждает, что полностью ознакомлен и согласен с настоящими Правилами, в частности, но, не ограничиваясь нижеследующим, и предоставляет свое согласие:

17.1. На участие в рекламных интервью об участии в Акции, в том числе для радио и телевидения, а равно для иных средств массовой информации, а также на осуществление Организатором и/или третьими лицами по заданию Организатора фото и видеосъемки Участника, а также на использование созданных фото и видеозаписей с Участником без получения дополнительного согласия на такое использование и без уплаты какого-либо вознаграждения за такое использование, в том числе в средствах массовой информации, в частности, в рекламных целях, с правом передачи права использования указанных фото и видеозаписей с Участником третьим лицам;

17.2. На получение от Организатора либо уполномоченных им лиц услуг в виде получения информационных email или иных рассылок, связанных с проведением Акции;

17.3. На осуществление Организатором, а также уполномоченными им лицами сбора, обработки (в том числе с применением автоматизированных средств), хранения, использования, распространения в целях проведения Акции собственных персональных данных Участников Акции с соблюдением необходимых мер защиты таких данных от несанкционированного распространения. Согласие является безотзывным и предоставляется на бессрочной основе.

18. Участник Акции является дееспособным и обладает всеми правами, предусмотренными законодательством страны участника Акции, для принятия участия в Акции и предоставления разрешения на обработку его персональных данных.

19. Организатор не несет ответственность за неисполнение им действий, связанных с проведением Акции, если такое неисполнение произошло вследствие удаления профиля  Участника Акции в результате отзыва Участником Акции согласия на участие в Акции или отказа от использования сайта megogo.net.

20. Акция не суммируется с другими акциями и скидками Организатора.

21. Настоящие Правила Акции для пользователей будут размещены на сайте megogo.net в период с 01.01.2018 г. по 31.12.19 г.

22. Порядок проведения Акции, настоящие Правила, а также любая деятельность, связанная с Акцией регулируются законодательством страны Организатора.

23. Все спорные вопросы касаемо данной Акции регулируются в соответствии с действующим законодательством страны Организатора.

24. Настоящие Правила являются единственными официальными правилами участия в Акции.

25. В случае возникновения у Участников Акции вопросов, последние могут задать их по электронной почте: support@megogo.net.

Terms of the special offer “Try Movies & TV subscription for 0,05”

1. Used terms:

1.1. Special offer “Try Movies & TV Subscription for 0,05” (hereinafter – Offer) is an offer organized by VASKIANI VENTURES LIMITED (hereinafter – Company), under which the User has a possibility to purchase “Movies & TV” Subscription for 30 calendar days at a special price in accordance with the Table #1 during the Offer period. At the end of the Offer period, the Participant can continue watching movies and channels, available by “Movies & TV” Subscription, at a regular price in accordance with the Table #1. By purchasing the “Movies & TV” Subscription at the special price using the credit card, the Participant agrees to automatic renewal of the subscription and withdrawal of funds at a regular price for the next period. After purchasing the “Movies & TV” Subscription at a special price, the User has the right to cancel automatic renewal of the Subscription in his user profile in accordance with the legislation.

2. Subscription – within the meaning of these Terms – “Movies & TV” Subscription.

2.1. The relevant list of channels is available on: http://megogo.net/ru/tv/channels

3. Offer Organizer: VASKIANI VENTURES LIMITED.

4. Offer period: from 01.06.2016 to 31.12.18 inclusive.

5. Validity of the special Subscription – 30 calendars days from the date of payment inclusive.

6. Area where the Offer is available: countries given in the Table #1.

7. The Offer is conducted on the website megogo.net.

8. The Offer is not a contest, lottery or other risk-based gambling game, raffle, etc.

9. Any registered user of the website megogo.net or any person who uses Smart TV application and who has purchased the Subscription for the first time can take part in the Offer. Re-activation or Subscription renewal is carried out at its regular price on the payment date.

10. Any individual with necessary legal capacity, according to the legislation of the Participant’s country, can take part in the Offer. The exception are employees, family members of the employees and representatives of the Offer Organizer.

11. Rights of the Offer Participant:

11.1. The Participant has the right to be informed about any changes in the terms or conditions, if such changes have been made.

11.2.  The Participant has the right to participate in the Offer on the conditions of these Terms.

12. Responsibilities of the Offer Participant:

12.1. The Participant is obliged to read the Terms of the Offer.

12.2. The Participant is obliged not to violate the conditions of these Terms.

13. Rights of the Offer Organizer:

13.1. Offer Organizer has the right to change the Offer Terms without prior notice to the Offer Participant.

13.2. If the Participant takes any action contrary to the law, the Organizer has the right to disqualify the violator from participation in the Offer.

13.3. The Organizer has the right to request from the Participant the necessary information and documents in the cases provided in these Terms, as well as other documents in order to submit them to the state authorities in cases stipulated by the legislation of the country of the Participant.

13.5. In the event of any circumstances preventing the conduction of the Offer (malfunctions or Internet failures that lead to impossibility of further conduction of the Offer), the Organizer has the right to suspend or early terminate the conduction of the Offer without penal sanctions.

14. Responsibilities of the Offer Organizer:

14.1. The Organizer is obliged to carry out the Offer in accordance with these Terms.

15. It is necessary to purchase the Subscription to become the Participant of the Offer.

16. The Organizer is not responsible for:

16.1. The Participant’s nonfulfillment (delayed fulfillment) of the responsibilities and observance of conditions provided by these Terms.

16.2. Correctness, accuracy and reliability of the data, contact and other information the Participant has specified when gaining access to the Subscription on the website megogo.net.

16.3. The Participant’s failure to gain access to the Subscription in case of absence of its demand or the Participant’s withdrawal from participation in the Offer, as well as other reason beyond control of the Offer Organizer.

17. The fact of participation in the Offer is voluntary. By taking part in the Offer, the Participant confirms that he/she fully understands and agrees with these Terms, including but not limited to the following, and gives his/her consent:

17.1. To participate in promotional interviews about the participation in the Offer for the radio and television, and equally for other media, as well as to be photographed and filmed by the Organizer and/or third parties on the instruction of the Organizer, as well to the use of the taken pictures and videos with the Participant without obtaining additional consent to such use and without paying any remuneration for such use, including in the media, in particular for advertising purposes, with the right to transfer the rights to use the mentioned pictures and videos with the Participant to the third parties;

17.2. To receive from the Organizer or his designated individuals services in the form of informational emails or other mail outs related to the Offer;

17.3. To have Participant’s personal data collected, processed (including automated means), stored, used and distributed by the Organizer and his designated individuals in order to conduct the Offer with the necessary measures to protect such data from unauthorized distribution. The consent is irrevocable and is provided on an indefinite basis.

18. The Offer Participant is a competent individual and has all the rights provided by the legislation of the Offer Participant’s country to take part in the Offer and grant permission for the processing of his/her personal data.

19. The Organizer is not liable for failure to perform actions related to the conducting of the Offer, if such failure occurred due to the Participant’s profile deletion as the result of the Participant’s withdrawal of consent to participate in the Offer or refuse to use the website megogo.net.

20. The Offer is not cumulative with other promotions and discounts of the Organizer.

21. These Offer Terms will be posted for users on the website megogo.net in the period from 01.06.2016 to 31.12.18 .

22. The order of the conduction of the Offer, these Terms, as well as any activities related to the Offer are regulated by the legislation of the Organizer’s country.

23. All disputes with regards to this Offer are regulated in accordance with the current legislation of the Organizer’s country.

24. These Terms are the only official rules of the participation in the Offer.
